Rental Conditions

1. Lease
A lease is always for a fixed term and ends at the end of the lease period without notice. The landlord also has the right to terminate the lease with immediate effect if the rent, electricity or water charges and final cleaning have not been paid within the agreed time (due date).

2. The apartment and its use restrictions
Smoking: Smoking is strictly prohibited in rental apartments. Smoking is only permitted outdoors/on the open balcony (in which case the tenant ensures that cigarette smoke does not enter the apartment in such a way that it causes an unpleasant odor) with the balcony door closed. If smoking is done in the apartment despite the ban, the tenant is liable to compensate for the cleaning costs and any damage/odor caused to furniture or other movable property. If necessary, the owner of the apartment determines the extent of the damage.

Apartment: The tenant may not transfer or rent the apartment or part of it to a third party. The apartment may also not be used for business. The tenant may not make any changes to the apartment without separate permission, attach signs, etc. that leave a mark on the apartment. Only the number of people who can stay in the apartment can stay overnight in the apartment. Additional people must always be agreed upon separately.

3. Liability for damages
When the property is handed over, it must correspond to the income situation in terms of movable property, real estate and yard. Tenants are obliged to take care of the apartment carefully during their stay and are responsible for any damage, breakage or lost items that occur during the rental. Damage must be reported immediately to the landlord’s representative, SUNHOME. The costs caused by the damage will be deducted from the security deposit or, if the security deposit is not sufficient to cover the costs caused by the damage, the tenant is obliged to pay the excess costs. If the tenant does not report the damage, the landlord has the right to charge a fee for the damage caused even after the termination of the rental relationship. In addition to the damage to be compensated, the costs caused by the work (35€/starting hour) will also be charged. The tenant must also notify the rental agent if he notices any defects in the apartment that he believes need to be repaired. If something is broken when the tenant arrives at the apartment, he/she must immediately notify SUNHOME.

The landlord or rental agent has not insured the tenants or their property during the rental.

4. Reservation fee / Deposit
The reservation fee is 200 euros/rental (contracts of less than 3 months) and for contracts of more than 3 months, one month’s rent.

The reservation and agency fee are not refundable in the event of cancellation of the rental (a significant shortening of the rental period is also considered a cancellation). However,
if the customer cancels their reservation six months before the start of the rental,
we will refund the reservation fee in full. The reservation fee will be transferred to the
guaranteed rent at the start of the rental, which will be returned to the customer’s account
within two weeks (14 days) of the end of the rental, if
everything is in order in the apartment. Since we make a larger number of returns
at once, the reservation fee may also be refunded on the very last day
of that 14-day period. The reservation and agency fee is always apartment and
reservation specific, and cannot be transferred to the next reservation. Changing the dates of the agreed

5. Keys
The tenant will be provided with two keys to the apartment. The landlord will also have a spare key to the apartment. The keys must never be left locked inside the door, as if the door closes and the residents happen to be outside the door, the door will no longer be openable. The tenant is responsible for the costs if the keys are not returned and/or the locks have to be changed due to the tenant’s negligence. For normal door opening outside the entrance, the rental agent will charge €60 on weekdays (8am-8pm) and €80 at other times. When the tenant leaves the apartment on their own, the keys must always be handed over to SUNHOME staff. An additional fee of 60€ will be charged for bringing/retrieving
keys in the Torrevieja and Orihuela Costa areas.

6. Cleaning
For technical reasons, a separate fee is charged for the end-of-stay cleaning of the apartment.
The end-of-stay cleaning price can be found on the presentation page of each apartment.
The end-of-stay cleaning also covers the compensation for washing the linen and towels at the time of departure (= 1 towel + 1 set of sheets
/person).
The tenant is responsible for cleaning the apartment and washing the changed linen and towels during the stay. The tenant must leave the apartment in a condition that corresponds to the usual level of cleanliness when handing over. The end-of-stay cleaning does not include taking out the trash, washing the dishes or emptying the dishwasher, which are the responsibility of the tenant. The costs of additional laundry, taking out the trash and washing the dishes/emptying the dishwasher are deducted from the guarantee rent. The handover cleaning also does not include cleaning any grills that may be found in the apartment, but each tenant is responsible for cleaning the grill themselves. For special cleaning, we charge 30€/starting hour + costs (possible laundry costs, mattresses, carpets, curtains). The tenant cannot do the handover cleaning themselves.

7. Housing association swimming pools / Housing association facilities
The swimming pool of the housing associations are available to tenants during the pool opening hours, which are announced in connection with the pool area rules, usually on a board on the wall of the pool area. The rules must be followed strictly for safety reasons. . No information is provided to the rental agent about any swimming pool renovations or changes in opening hours, so SUNHOME cannot take responsibility for the swimming pools being open during the tenant’s rental period. The condition of the housing association’s common areas (courtyard, elevator, staircase, etc.) and any maintenance work carried out in them are not the responsibility of the landlord or the rental agent.

8. Internet connections / TV
The landlord or rental agent is not responsible for any interruptions in the Internet connection or slow connection, but will forward the tenant’s fault report to the service provider. Under no circumstances should the modem’s reset button be pressed, as some modems’ data will be reset and the fault can only be repaired by the service provider’s technician. In this case, the tenant will pay the technician the costs of reprogramming. The apartments’ Internet connections operate wirelessly and the tenant will receive the access codes for them in the apartment. The visibility of TV channels may vary depending on the apartment.

9. Change
The landlord or rental agent is not responsible for damage to the tenant’s property or personal injuries. The apartment is rented for temporary use only, so the tenant does not have the right to change his official address to the apartment unless the matter is agreed in writing in advance. The tenant must ensure that the apartment is sufficiently ventilated to avoid mold growth. Awnings or parasols must not be stored open, but must always be put away after use. The rental apartment is rented with the equipment that is there. Additional purchases are only made after consideration with the apartment owner. The price per kWh of electricity is determined according to the tariff for the rental period.
